Contract For Services
This agreement constitutes a binding contract for videography/photography services and/or products. By signing this Agreement, the client agree to pay GH Productions LLC, for the services provided by him at the prices set by both the Clients and GH PRODUCTIONS LLC. The following terms and conditions shall also apply to Client’s engagement of GH PRODUCTIONS LLC
1// EXCLUSIVITY:
GH PRODUCTIONS LLC shall be the only media production company retained by the Clients for this project and term agreement. Family and friends of Client shall be permitted to photograph/videotape the event, for non-commercial purposes, provided that such person or persons do not interfere with the photographer’s duties. If in my opinion, such person or persons are inhibiting the photographer from performing his duties, Client shall require the person interfering with the videographer/photographer to stop all further videotaping. GH PRODUCTIONS LLC is exclusive to the client and will not provide captured videos or photos content to anyone outside of the client. GH PRODUCTIONS LLC is the sole media production company for the client. If necessary, assistants to such photography/videography shall attend the production sessions.
2// NON-REFUNDABLE RESERVATION FEES:
A 50% deposit is due upon the signing of this agreement. Once the Agreement is signed and the deposit is paid, GH PRODUCTIONS LLC shall reserve scheduled production dates. Once agreed upon, the time and date for production will be exclusive to the client, and no reservations shall conflict with these times. For this reason, all deposits are NON-REFUNDABLE.Should any check fail to clear the account against which it is drawn (for any reason, including insufficient funds), Client shall pay an additional fee of $50.00. As well as any additional fees that any money transfer services charge.
3// CHANGE IN DATE, TIME, PACKAGE SELECTION, or TERMINATION:
Client may upgrade Clients package selection at any time. However, under no circumstances shall Client be permitted to change its selection to a lower-priced package. In case of a change in the time or date of production sessions, GH PRODUCTIONS LLC shall make reasonable efforts to accommodate the change. However, if the new time or date conflicts with GH PRODUCTIONS LLC existing schedule, GH PRODUCTIONS LLC reserves the right to reschedule. In the event of rescheduling, Client shall forfeit any previous non-refundable deposits. If the project production time exceeds the amount agreed upon in the service details, the client will be required to pay the outstanding balance that has been incurred due to the additional time of production.
4// COMPLETION OF FINAL PRODUCT:
The entire editing process, from time of scheduling to receipt of the final products will be due 14 business days after production dates. If the client wishes to choose a product from the A La Carte section, the same process for final video products will be due 14 business days after production dates. Revisions to videos will grant GH PRODUCTIONS LLC an extra three days to edit the video and are not subject to this charge. Any inconvenience that prohibits the completion of a project, such as illness, power outages, etc., shall be acknowledged and will not reflect turnaround time nor discount of service.
5// PUBLICITY RIGHTS/PROMOTIONAL USE OF IMAGES:
The parties agree that GH PRODUCTIONS LLC may use pictures/ footage from the Client’s productions sessions for commercial use, including, without limitation, promotional videos/ pictures for exhibition to other potential clients of GH PRODUCTIONS LLC.
6// CREATIVE CLAUSE:
It is understood that GH PRODUCTIONS LLC is the exclusive official videographer retained by the Client to create video and photo content. GH PRODUCTIONS LLC is granted full editorial, production, and content control by the Client regarding all aspects of the production and postproduction services. The client is granted 1 revision to the final edited product, this does not include changing the song of choice. Any request for the changes to the final edited product after the first revision that are not the result of errors by GH PRODUCTIONS LLC will be made at the current rate of $100/hr for editing and labor. We are not responsible for shots that are missed or omitted because of the videographer being blocked. GH PRODUCTIONS LLC retains the exclusive right to edit all footage.
7// Service Details & Payment:
The service details and payment for each project/booking will be determined by the package chosen by the Client, as outlined in the signed Agreement.
